Assets under pressure
A property securing a debt, proceedings at the door, a value at risk of dispersal. We act as advisor to the owner, to find the solution before someone else decides it.
The situation
A recurring situation: a family-run hospitality property, trading for decades, with a bank exposure secured on the building. Turnover no longer covers the instalments, the bank has sold the loan, and the new creditor has started proceedings. The family wants to avoid the auction (where the property would sell at a fraction of its value), but does not know where to turn: the bank is no longer the counterpart, the lawyer follows the proceedings, agents do not handle situations of this kind. Time passes, and the position worsens every month.
How we work
We analyse the asset, the business, the debt position and the pending proceedings, verifying the technical, cadastral, planning and accounting documentation. From there, the strategy: disposal of the property or of the business, debt restructuring, negotiated settlement, or conversion (a hotel can become student accommodation, a care residence, a different asset), where the new use is worth more than the old.
We identify and activate investors, buyers or operators from our institutional network, preparing presentation materials in anonymised form and managing information flows with confidentiality. We coordinate negotiations with counterparties and, where needed, with creditors and the bodies of the proceedings. We assist through to the signing of the final agreements.
We act as advisor to the owner and not as a party to the transaction: the mandate is an obligation of means, and decisions remain with the owner.

Frequently asked questions
Is it too late once proceedings have started?
It depends on the stage. The earlier the intervention, the more routes remain open; but even with proceedings under way there is room (agreements with the creditor, sale before adjudication, conversion of the attachment) which we assess case by case. The first conversation serves to establish which.
Do you negotiate with the bank or with whoever bought the loan?
We assist the owner in those discussions and conduct them where a technical counterpart is needed. Decisions remain with the owner: we are advisor, not party.
How do you protect confidentiality?
Materials for investors and operators are anonymised; the identity of the property and of the owner is disclosed only to qualified counterparties, once negotiations are under way and under a confidentiality undertaking. No listing, no public exposure.
