Start before signing
The Italian National Council of Notaries explains that an accepted purchase offer can already constitute a preliminary contract. It should not be treated as a simple reservation: its terms, conditions and consequences deserve professional examination before signature. [1]
Build the document file
The Council’s guide recommends professional assistance from the offer stage and highlights checks on cultural and landscape restrictions and saleability. The scope of the checks depends on the property and the right being acquired. [2]
Our reading: coordinate the checks
An initial agenda can cover the title of acquisition, available cadastral and building documents, occupancy and condominium information. The appointed notary and technical adviser define their respective checks. A folder full of files does not, on its own, amount to completed due diligence.
Make open questions explicit
Before committing, establish which documents are missing, who will obtain them and when. Financing needs or proposed works should also be discussed with the professionals advising on the purchase, so that the offer’s conditions reflect the actual project. These general pointers do not replace examination of an individual contract.
